1. Licence & intellectual property (protecting this App)

Unless App Store Connect lists a custom licence, your download and use of the App are also subject to Apple’s Standard End User Licence Agreement (EULA), Apple’s Media Services Terms, and Apple Privacy Policy.

• Ownership. The App software, UI, original wording of study questions (paraphrased study items), explanations, curated structure, artwork, icons, route-map assets we publish, branding, and this website are owned by DOBBY MIDNIGHT or its licensors. All rights not expressly granted are reserved.
• Limited personal licence. Subject to these terms and the Apple EULA, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own exam preparation on devices you own or control via the App Store.
• Not official exam papers. Questions are independently paraphrased study items compiled from publicly available materials (e.g. road users’ code / published booklets / place knowledge). They are not official exam papers and must not be represented as such.
• Prohibited uses. You must not, except to the extent permitted by applicable law: (a) copy, scrape, harvest, mirror, or republish the question bank, assets, or site content in bulk; (b) reverse engineer, decompile, or circumvent technical protections; (c) resell, sublicense, or commercially redistribute the App or its content; (d) use the App or our servers to build a competing question bank or training product; (e) remove copyright, trademark, or proprietary notices; (f) misrepresent the App as an official Transport Department product.
• Trademarks. “運輸署”, Transport Department names/logos, and third-party marks remain their owners’ property. Mention of official materials is for factual reference only and does not imply endorsement.
• Feedback. If you submit reports or suggestions, you grant us a worldwide, royalty-free licence to use that feedback to operate and improve the App and banks, without obligation to credit or compensate you.
• Enforcement. We may investigate abuse (including automated scraping of Hosting / CDN endpoints) and may suspend access, refuse support, pursue civil remedies, and report unlawful activity where appropriate.

2. Privacy summary

• Study progress, miss pools, answer stats, streak / study duration, and preferences are stored primarily on your iPhone (UserDefaults / app storage).
• Question banks and the anonymous “hardest questions” leaderboard may update online. App version matters: older releases may keep a local bank for study when download fails; newer releases stream questions and need a network for study and mocks.
• Optional “Report this question” uploads go to Firestore so we can fix errors (manual content reports — not the same as answering incorrectly).
• Optional in-app “意見收集” feedback may upload your chosen ratings, free-text note, and optional contact email if you provide one.
• Anonymous batches of question IDs only (when you answer incorrectly in study / mock exams) may be uploaded to improve the community hardest-question board.
• When you first reach about 70% unique questions answered in a part, the App may send a one-time anonymous coverage milestone (counts only; no name).
• Newer app versions may upload one anonymous daily increment of answer counts (totals only; no question IDs).
• Crashlytics collects crash / diagnostic data to improve stability (Release builds).
• From a later app version, an optional AI tutor may send your question text off-device to generate an answer (see 3.9). Study and mocks still work if you do not use it, or if the tutor is unavailable.
• No sign-up screen, no ads, no cross-app advertising trackers. Optional Firestore writes (reports, feedback, anonymous tallies) use Firebase Anonymous Authentication in the background — there is no account registration UI, password, or profile. The AI tutor (when offered) uses the same anonymous session to enforce a daily question limit.

3. Data we process

3.1 On-device data (not uploaded for account sync)

• Study progress, missed question IDs, answer statistics, study checkpoints
• Preferences (e.g. auto-advance on correct answer)
• Cached question banks (Application Support; excluded from iCloud backup where configured)

Clearing in-app progress or deleting the App removes on-device data under your control. Device backups (e.g. iCloud Backup) may still include app data according to your system settings.

3.2 Question-bank updates (CDN)

The App may request HTTPS resources from https://taxi.dmhongkong.com (manifest / JSON / images). These requests do not include your name, email, or study progress. Standard network metadata (e.g. IP address) may be processed by hosting infrastructure as part of delivering content.

3.3 Optional question reports

If you submit “Report this question”, the App writes to Google Firebase Firestore (project taxi-parta-quiz), typically including: question ID, part, category, truncated stem preview, reason, truncated free-text note, app version, bank version, platform (iOS), and timestamp. Do not include personal identity data in reports. We use this to correct banks and assets.

3.4 Anonymous miss batches (錯題收集箱 / community hardest)

When you answer incorrectly, the App may upload batches of question IDs to Firestore collection miss_batches (e.g. roughly every 50 study misses, or missed IDs from a submitted mock exam). Payload is limited to IDs, source (study / exam), app / bank version, platform, and time — no names, options, or dwell time. We aggregate these into a public Top-20 “hardest” list on our CDN (/stats/hardest.json) so the App can offer community hardest practice. This is not the same as “Report this question” (section 3.3). Upload failure does not block study. The client applies interval and daily rate limits.

3.5 Coverage milestones (≈70% of a part)

The first time you have answered about 70% of unique questions in Part A or Part B, the App may create one Firestore document in coverage_milestones with part, threshold (70), answered count, bank size, versions, platform, and time — so we can estimate how many learners reach that coverage. No name or install advertising ID. At most one successful send per part per install (reinstall may send again).

3.5a Daily attempt totals (from a later app version)

Once a day, the App may upload an anonymous increment of how many items you answered since the last successful send (study plus submitted mock answers) to Firestore attempt_batches: counts only (Part A / Part B / total), a calendar day key, versions, platform, and time — no question IDs, names, or options. Used to estimate overall practice volume. One successful create per install per day. Upload failure does not block study. Older binaries already on a device do not send this until updated.

3.6 Crash diagnostics (Crashlytics)

Firebase Crashlytics may collect crash reports and related diagnostics (e.g. device model, OS version, stack traces, and a device/install identifier used for stability—not an advertising ID), processed by Google on our behalf to fix crashes and improve the App.

3.7 Optional in-app feedback（意見收集）

If you open “意見收集” and submit, the App may write to Firestore collection app_feedback: optional satisfaction / improve-area choices, a truncated free-text note, an optional contact email if you enter one, which screen you opened from, app / bank version, platform (iOS), and timestamp. Feedback is used to improve the App. Do not include identity documents or unnecessary sensitive data. Client rate limits apply. Upload failure does not block study.

3.8 Links you open yourself

Some items may open Google Maps search, Chinese Wikipedia, or reference web pages. Those destinations operate under their own policies; we do not control their content or tracking.

3.9 Official-materials AI tutor (from a later app version)

Later versions may offer an optional AI tutor that answers questions about Transport Department study materials. This feature is not an official Transport Department service. Answers are generated by an AI model and can be wrong. Always treat the latest official publications as authoritative. Official handbooks and web pages remain the copyright of the Government / Transport Department; excerpts are used for personal exam study only. Tutor answers are not legal advice.

Using the tutor requires a network connection. There is a daily question limit per user (currently 20 per UTC day). Your question text leaves the device: it is sent to our Cloud Function on Google Cloud (project taxi-parta-quiz, region asia-east1) and forwarded to DeepInfra (United States) to run the model. Optional voice input uses Apple speech recognition and your microphone on device (prefer on-device when available); we do not upload raw audio files—only the text you send as a question is forwarded as above. Spoken answers use on-device text-to-speech. We do not persist your question text in Firestore (only anonymous quota / spend counters). We do not control DeepInfra’s logs or retention. Do not include names, ID numbers, or other personal data in tutor questions. Tutor failure does not block MCQ study or mocks on versions that still allow local-bank practice; on streaming versions, study and mocks also need a network.

5. Retention & deletion

• On-device data: controlled by you (clear progress / delete App).
• Reports, feedback, and miss batches: retained while needed to operate and improve the bank / App; you may email us to request deletion (please include approximate time of submission).
• Tutor quota / spend counters: retained while needed to enforce daily limits; we do not store tutor question text.
• Crashlytics: retained under Google / Firebase defaults.

6. Children

The App is intended for adults preparing for a vocational written exam. We do not knowingly collect personal data from children under 13.

7. Disclaimers & limitation of liability

• The App and website are provided on an “as is” and “as available” basis for personal study. Content may lag behind the latest official publications. Always treat Transport Department notices and official materials as authoritative if anything differs.
• The optional AI tutor is unofficial, may be wrong, is not legal advice, and does not replace official handbooks. Official materials remain the copyright of the Government / Transport Department and are for personal study only.
• Study features (including wrong-question practice and “practice until you get it”) do not guarantee any official exam result, pass mark, or score.
• The community hardest list (“錯題收集箱”) depends on anonymous sample size. It may be delayed, incomplete, temporarily hidden until enough data exists, or unavailable. It does not equal official exam difficulty.
• To the fullest extent permitted by applicable law, DOBBY MIDNIGHT is not liable for exam outcomes, lost profits, or indirect / consequential damages arising from use of the App or reliance on study content.
• Nothing in these terms excludes liability that cannot be excluded under Hong Kong law.

8. Purchases, licence & Family Sharing

• If the App is sold on the App Store, payment and refunds are processed by Apple under Apple’s terms and refund policies. We do not process your card directly.
• There is no separate in-app account. Your licence follows Apple’s rules for the Apple ID / devices you use, including Family Sharing where Apple enables it.
• A paid purchase covers the App features as offered at the time; we may add, change, or remove content and features later. We do not promise perpetual free extra online services beyond what Hong Kong law requires.

9. Online services, third-party links & acceptable use

• We may modify, suspend, or discontinue online services (including question-bank CDN updates, the hardest-question list, telemetry endpoints, the AI tutor, streaming sessions, or site pages) without liability beyond what Hong Kong law requires. Where a given App version still ships or caches a local bank, that version’s local study may continue when online services are unavailable; streaming versions require a network for study and mocks. The tutor requires a network connection and is subject to a daily limit.
• Links to Google Maps, Wikipedia, Transport Department pages, or other sites/apps are for convenience only. We do not control their content, availability, or privacy practices; a link is not an endorsement.
• In addition to the prohibited uses in section 1, you must not use bots or scripts to flood reports, feedback, miss batches, tutor questions, or other endpoints, and must not submit abusive, unlawful, or knowingly false content in report / feedback / tutor fields.
• Website marketing copy about availability is informational only. Purchase, price, and refunds follow the App Store listing and Apple’s terms.
• If the App offers printable PDFs or similar study sheets, they are for personal study only, remain our copyright (and any stated watermark / disclaimer applies), and must not be presented as official exam papers. Where printing uses our servers, we apply an anti-abuse daily quota (the limit may change) and the request needs a network connection; we do not need your name for this quota.

10. Changes

We may update this page and will revise the effective date. Material changes may also be noted in the App or on the site.

11. Governing law

These terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-law rules. Courts of Hong Kong have non-exclusive jurisdiction, subject to mandatory consumer protections where they apply.
